What are My Rights as an Employee?

As a Long Beach employee, you have several rights that protect you from workplace issues. Knowing your rights gives you an upper hand when dealing with employee-employer disputes. The rights include but are not limited to:
Right to File a Complaint
Suppose your employer has harassed or retaliated against you or a coworker. In that case, you can file a complaint with a government agency such as DFEH (California Department of Fair Employment and Housing).
Right to Fair Pay
You are entitled to receive the minimum wage set by the state. In addition, your employer must compensate you overtime pay (1.5 times the regular rate) for hours worked over 8 in a day or 40 in a week. You can file a complaint against wage disputes if this does not happen.
Right to Protection for Whistleblowing
If you have reported a legal violation to government agencies, you are protected under California’s whistleblower laws.
Right to Take Eligible Leaves
If eligible, you can take various leaves, including family and medical leave, pregnancy disability leave, and paid sick leave.
Right to Receiving a Proper Explanation
Suppose you were wrongfully terminated without a valid reason or notice (as mentioned in your employment contract). In that case, you can question your employer or file a complaint against the wrongdoing.

Why Do I Need a Long Beach Employment Law Attorney?

It is not mandatory to appoint a lawyer for filing a complaint, but you are very unlikely to succeed without one. In an at-will state like California, the burden of proof is on the victim, so having our employment lawyers can make all the difference.
In-depth Knowledge of Local Labor Laws
California has its own employment regulations, often more protective than federal laws. For instance, the state’s FEHA (Fair Employment and Housing Act) protects all employees from harassment, retaliation, discrimination, and workplace-related misconduct. Our experienced attorneys thoroughly grasp state and local nuances to ensure your case is presented accurately.
Protection Against Employer Retaliation
California’s Labor Code protects employees against retaliation for lawful conduct outside of work, whistleblowing, and many other activities. Our experienced employment law attorney can guide you in understanding your rights and ensuring you are protected throughout the complaint process.
Adherence to Proper Procedures
Filing a complaint against an employer, primarily through state bodies like the DFEH, requires adherence to specific procedures. We never miss a deadline and provide the necessary documents to prevent your claim from getting jeopardized.
Court Representation
Should your complaint escalate to a court case, having our seasoned attorneys ensures you are heard and effectively represented. We will fight on your behalf, advocating for your rights and interests.

Our Services

Wage & Hour Disputes

Does your employer owe you unpaid wages? Are you not being paid for overtime? Perhaps you are fighting for the wages you are entitled to receive? Hershey Law in Los Angeles offers a deep understanding of employment law. Additional to wage and hour laws, lunch break law violations commonly occur in California.

Discrimination

Discrimination happens when an employer or supervisor treats one person differently than another based on protected characteristics such as race, color, sex, sexual orientation, national origin, religious beliefs, gender identity, and age. Gender discrimination can also be in the form of offering less pay to a woman.

Harassment

Harassment lawsuits are often the product of discrimination, stalking, malicious behavior, and other forms of harassment. Usually, workplace harassment cases target race, color, national origin, ancestry, gender, religion, religious practice, age, disability, or sexual orientation.

Whistleblower

A ‘whistleblower’ exposes information within a company or organization that is illegal, fraudful, unsafe, illicit, or abusive. The federal government and many states have laws protecting whistleblowers from retaliation for filing a claim or reporting a violation.

Wrongful Terminaiton

Individuals are too often fired or terminated illegally without reason. At Hershey Law, we offer free consultations for employment law, discrimination, and wrongful termination cases in Los Angeles & Southern California to help you receive what may be owed.

Retaliaiton

Delivered in various forms, retaliation is any adverse employment action unlawfully taken against an employee including, but not limited to: Termination, Demotion, Performance Improvement Plans, Write-Ups, Change in Schedule, Reduction of Hours…

"I would like to say that I am 100% satisfied and happy that I chose Hershey Law to represent me and my colleagues through a tumultuous employment matter! From the very beginning, Mr. Hershey and his colleagues (shout out to Santiago!) were validating and understanding of the case we were presenting. They wholeheartedly invested their time and expertise to guide us through a process that most (including us) found overwhelming. I appreciate their support in dealing with the challenging aspects of the case in addition to addressing the emotional aspects of us, the individuals they were serving. We obtained a favorable outcome and couldn’t be more grateful! Hershey law treats you with value and respect and you’re not just another number in the Rolodex. Thank you for fighting for us, Mr. Hershey and Santiago!!! I highly recommend!"

I am very thankful and happy that I followed reviews in choosing Hershey Law as my lawyers! Being injured, I couldn't drive and Brennan came and met me at my house. He made me feel comfortable, taken care of and relieved a lot of stress from my incident. Even with all we've/are living through with the pandemic and everything else 2020 has brought, my care, health and case never suffered nor did I feel neglected. They were always available to answer my questions. It was great to deal with a local law firm where I felt personally taken care of. Jonny was a great lawyer and helped me through the whole case. The office staff...Jesse, Santiago and Blanco were a pleasure to deal with!
